MATCHA Paris - GENERAL CONDITIONS OF SALE
1. PREAMBLE
These General Terms and Conditions of Sale govern relations between MATCHA-PARIS-AS Peyre, located 106 Avenue Ferdinand de Lesseps, 34110 Frontignan, registered under SIRET number 539 223 586 00014 and all natural or legal persons hereinafter referred to as "the buyer” wishing to make a purchase on the website www.matchaparis.com

2- PURPOSE
These conditions of sale aim to define the contractual relationship between MATCHA-Paris and the buyer and the conditions applicable to any purchase made through the MATCHA-Paris merchant site, whether the buyer is a professional or a consumer. The acquisition of a good or a service through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by MATCHA-Paris.
MATCHA-Paris reserves the power to modify its general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the products offered
The products offered are those listed on the MATCHA-Paris website. These products are offered within the limits of available stocks.
Each product is accompanied by a description and the most accurate photographs possible. Viewing on the site and configuring computer stations does not always ensure perfect similarity with the product offered.
Prices
The prices are indicated in euros including tax. The applicable VAT rate is the rate in force on the day of the order. MATCHA-Paris however reserves the right to pass on to the Buyer any change in the VAT rate applicable to the order. The seller reserves the right to modify its prices at any time. However, he undertakes to invoice the goods ordered at the price indicated when the order is registered. The prices indicated do not include transport and shipping costs.
3 - ORDER TERMS:
The Buyer who wishes to buy a product must:
* Follow the order process, including the acceptance of these general conditions of sale
* Fill in the identification form on which he will indicate all the requested details
* Choose the items it adds to the cart
* Validate the contents of the basket
* Make the payment under the conditions provided
- Confirm your order and payment.
The buyer will receive an order confirmation email.
All the data provided and the recorded confirmation will be worth proof of the transaction, the e-mail confirmation of the recorded order will be worth signature and acceptance of the operations carried out.
4 - PAYMENT TERMS
Any order will only be considered after acceptance of payment.
The price is payable when ordering.
Payments will be made by a PAYPAL account or by credit card. In this case, they will be made through the secure system which uses the Stripe secure web payment infrastructure protocol (certified PCI level 1, the highest level of security) so that the information transmitted is encrypted by software and that no third party can become aware of it during transport on the network. The buyer's account will only be debited when the available products are shipped and only for the amount of the products sent.
5 - DELIVERIES
The risks are borne by the Buyer from the moment the products leave the premises of MATCHA-Paris. In the event of damage during transport, the reasoned protest must be made to the carrier within three days of delivery. Delivery times are indicative. These deadlines are those displayed by the various carriers (La Poste, etc.). Orders are sent by letter or parcel followed, which allows, through us, to trace your parcel if it does not reach you. The buyer is delivered to his home by his postman. In the event of the buyer's absence, he will receive a delivery notice from his postman, which allows him to withdraw the products ordered from the nearest post office, for a period indicated by the postal services. The buyer is required to check, in the presence of the post office or delivery person, the condition of the packaging of the goods and their contents upon delivery.
These deadlines can be upset by strikes, export problems, customs modifications and other external problems for which we cannot be held responsible, or by any other technical problems beyond our control.
Any reasonable delay in the delivery of the products cannot give rise to the benefit of the buyer to the allocation of damages or to the cancellation of the order.
The Buyer is required to check the good condition of the items delivered. Any anomaly noted (missing item, damaged package, broken item, etc.) must be indicated within 4 days of receipt.
6- RIGHT OF WITHDRAWAL
The buyer has a right of withdrawal within 14 days. The withdrawal period expires 14 days after the day on which the Buyer, or a third party other than the carrier and designated by the Buyer, comes into physical possession of the items. If the end of the period ends on the weekend or on a public holiday, the period is extended until the next working day. During this period he may, at his own expense, return a product that does not suit him.
Return costs are the responsibility of the Buyer.
The return of the product(s) must be made within 14 days of sending the withdrawal. Any return must be reported in advance and validated with MATCHA Paris by sending an email to our email address contact@matchaparis.com specifying your order number. The product must be returned by follow-up mail, follow-up letter type, to the following address: MATCHA Paris,

Only products returned as a whole will be taken back, in their complete and intact original packaging, and in perfect condition for resale. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.
In the event of the exercise of the right of withdrawal, the Buyer has the choice to request either the reimbursement of the sums paid, or the exchange of the product. In the case of an exchange, the re-shipment will be at the Buyer's expense. In the event of a refund request, payments for the product(s) purchased from MATCHA-Paris will be refunded to the Buyer within 14 days.
During the sales period and during exceptional promotions or clearance sales, the items sold are neither taken back nor exchanged.
7 - RESPONSIBILITY
MATCHA Paris in the online sales process is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
8 – INTELLECTUAL PROPERTY
MATCHA Paris is a trademark registered with the INPI. The models, jewelry accessories, drawings, photos, objects and images offered by the site www.matchaparis.com are the property of MATCHA Paris and are protected by intellectual property law, in particular governed by international copyright law and author's rights. The buyer acknowledges that the use he can make of the products ordered is limited to a use in accordance with their destination. Any other use of the models, drawings, logos , photos, objects and images, such as reproduction, reproduction of the site (even partial), marketing, distribution and editing by anyone is strictly prohibited and constitutes an infringement that can be punished criminally and civilly.
9- SETTLEMENT OF DISPUTES
These online sales conditions are subject to French law. For all disputes or disputes, the competent court will be that of Paris.
